Saiful Apek And Three Friends Freed Of Drug Charge
Comedy actor Saiful Apek and his three friends were on Monday acquitted and discharged by the Magistrate's Court here today for consuming drug two years ago.
Magistrate Ahmad Solihin Abd Wahid ordered the comedy actor, whose real name is Mohd Saifulazam Mohamed Yusoff, and his friends to be freed after finding that the prosecution had failed to establish a prima facie case against them.
In his judgment, Ahmad Solihin said the defence had succeeded in raising doubts on the case by bringing up, among others, the issue on the contradictions in the labelling of dates on the urine sample bottles, the urine samples being kept for too long, the presence of two forms for the urine tests and failure to prove there was an element of calibration and quality control in the test.
On Nov 1 last year, Saiful Apek, 43, Shah Zainatull Ehsan Al-Muazam Shah Yahya, 28, Shaiful Baharom, 24, and Noremy Mohamad, 28, pleaded not guilty to a charge with self-administration of cannabis at the Narcotics Criminal Investigation division office of the Subang Jaya police headquarters in Seri Kembangan here at 11pm on June 12, 2010.
The offence carries a maximum jail sentence of two years or RM5,000 fine, if found guilty.
